Digital video recording pioneer TiVo Inc. Aug. 21 said it looked forward to presenting oral arguments Oct. 4 in federal court regarding a patent infringement lawsuit brought against satellite-TV provider EchoStar Communications Corp.
Last October, a U.S. Court of Appeals denied a permanent injunction against EchoStar handed down previously by a lower court judge that had granted TiVo permanent injunction and $89.8 million in damages against a rival digital video recorder (DVR) device from EchoStar.
“We had requested prompt oral argument and are pleased that the United States Court of Appeals for the Federal Circuit has scheduled the oral argument,” said TiVo, in a statement. “This action brings us one step closer to resolution of [the] appeal and implementation of the district court's injunction.”
